Terms and Conditions for the Purchase of an E-book

The e-book is intended solely for the personal use of the user, who can be an individual or a legal entity. The user is not authorized to reproduce, rent, loan, exhibit, communicate to the public, or otherwise provide the e-book to third parties. The user is not allowed to modify the content of the e-book or interfere with it in any way, or combine it with another work, translate it, or convert it into another form, such as a printed book. Printing the e-book is not possible! Criminal liability with all its consequences applies to the user.

For the purposes of these Terms and Conditions, an e-book refers to a delivered work converted into a digital electronic file in Adobe PDF format.

To order an e-book, the user must provide the billing details to the Glass and Jewelry Museum (hereinafter referred to as MSB) for invoice issuance. MSB considers these details to be correct, and the user is responsible for their accuracy. The user is obliged to check their order and all the information provided in it. MSB is not responsible for any damages resulting from errors or incorrect information.

After completing the order form, MSB will promptly send an order confirmation (order acceptance) to the user's specified email address. The confirmation will include the order number, the name and specifications of the service, price information, contact details of the provider, and any additional information. If the user does not make the payment within 7 working days or cancels the order by sending an email to info@msb-jablonec.cz, the order will be automatically canceled.

Access to electronic content. Upon payment of the price specified by the provider to the bank account number 1232081/0710, for the chosen e-book from MSB's offer, the provider will send the electronic content to the user via the Úschovna.cz online service. By sending, it means sending a link to download the e-book in PDF format to the user's provided email address. At the same time, a tax receipt for the delivered e-book will be sent to the user. The user will retrieve the electronic content by downloading it from the Úschovna.cz service within 14 calendar days from the date of sending. From the moment the provider sends the download link for the electronic content, the provider's obligations are considered fulfilled.

All offered e-books on the MSB website are VAT-exempt according to Section 61 letter e) of the VAT Act. The prices are stated in Czech crowns.

Complaints

In the case of an e-book, the user's lack of knowledge that it is electronic content is not considered a valid reason for complaint. The user has the right to complain about defective electronic content according to Section 2165 and Section 2389a of the Civil Code. MSB guarantees to the user that the electronic content is free from defects. Defects for which the provider is not liable are those caused by the user themselves or cases arising from the nature of the matter.

The user has the right to complain about the e-book in the following cases:

  • The user has paid for the e-book but did not receive the download link by email.

  • After downloading the e-book file, the user discovers that the file contains a different e-book than originally ordered.

  • The file containing the electronic content is damaged and cannot be displayed.

Once the user identifies a defect, they must promptly notify MSB so that the defective electronic content can be examined. If the complaint is justified, the provider is obliged to promptly repair the defective electronic content or refund the user's payment within the legally prescribed period. The same payment method used for the initial transaction, i.e., bank transfer, will be used for the refund. The user will not incur any additional costs under any circumstances.
